Most Trump tariffs ruled illegal in blow to White House trade policy
A federal appeals court ruled Friday that most of President Donald Trump's global tariffs are illegal, striking a massive blow to the core of his aggressive trade policy.
The U.S. Court of Appeals for the Federal Circuit in a 7-4 ruling held that the law Trump invoked when he granted his most expansive tariffs does not actually grant him the power to impose those levies.
The appellate court paused its ruling from taking effect until Oct. 14, in order to give the Trump administration time to ask the Supreme Court to reverse the decision.
Trump later Friday attacked the appeals court as "Highly Partisan" and asserted that the Supreme Court will rule in his favor.
Appeals court says Trump unlawfully leaned on emergency powers to impose tariffs
A federal appeals court ruled Friday that President Donald Trump unlawfully leaned on emergency powers to impose sweeping tariffs earlier this year.
âBecause we agree that (the International Emergency Economic Powers Actâs) grant of presidential authority to âregulateâ imports does not authorize the tariffs imposed by the Executive Orders, we affirm,â the Federal Circuit said in an unsigned opinion upholding a lower-court ruling against Trumpâs tariffs.
The tariffs remain in place for now, after the court delayed implementation of its order until October. That gives the Trump administration time to file an appeal with the Supreme Court.
âAll tariffs are still in effect!â Trump posted late Friday on social media. âIf these tariffs ever went away, it would a total disaster for our country.â

Supreme court will now have to rule on issue of if president overstepped his authority in upending trade policy
Donald Trump overstepped his presidential powers with most of his globe-rattling tariff policies, a federal appeals court in Washington DC ruled on Friday.
US law âbestows significant authority on the president to undertake a number of actions in response to a declared national emergency, but none of these actions explicitly include the power to impose tariffs, duties, or the like, or the power to taxâ, the court said.
The courtâs decision will likely mean that the supreme court will have to rule on whether Trump has the legal right as president to upend US trade policy. The court also said the ruling wouldnât take effect until 14 October.
