Colorado state officials and the Colorado County Clerks Association are asking Gov. Jared Polis to deny a request that would transfer former Mesa County Clerk and Recorder Tina Peters from the custody of the Colorado Department of Corrections to federal custody.

Peters is an election denialist who was convicted for allowing unauthorized access to a voting machine in 2022. Since then, her case has garnered national attention as her supporters push for her release.

Now, the Federal Bureau of Prisons has requested that the Colorado Department of Corrections transfer Peters into federal custody. The move drew sharp criticism from the bipartisan Colorado County Clerks Association and state officials, who argue the transfer request would bow to political pressure and circumvent the law.

Prosecutor, attorney general urge Gov. Polis to ignore requests to aid Tina Peters

A request from the Trump administration to transfer former Republican Mesa County clerk Tina Peters from state to federal custody is opposed by state officials including the Republican district attorney who prosecuted the case and clerks across Colorado from both political parties.

They are urging Democratic Gov. Jared Polis’ administration to keep Peters in state custody and worry moving her to federal custody to a lower level of supervision would allow her to “continue disseminating the same false narratives that have already endangered clerks throughout Colorado and across the country.”

Peters is currently incarcerated at the La Vista Correctional Facility, a medium-security facility for women located in Pueblo. In 2024, a state judge sentenced Peters to nine years in prison and jail, after she was found guilty of several felonies stemming from her efforts to help a man gain unauthorized access to Mesa County’s Dominion voting machines in 2021.

Colorado officials, county clerks urge Polis not to transfer Tina Peters to federal custody

DENVER — Colorado officials are petitioning Democratic Gov. Jared Polis not to transfer convicted former Mesa County Clerk Tina Peters to federal custody after facing pressure from the Trump administration to do so, a strategy her supporters have proposed to free her from prison.

This week, two letters addressed to Polis urge that he reject the push by President Donald Trump's administration for Peters' move: one from Colorado Attorney General Phil Weiser (D) and Mesa County District Attorney Dan Rubinstein (R), and another from the Colorado County Clerks Association. Both letters contend that Peters' transfer would be harmful to the state's judicial integrity.
